By using darkrain’s services, including but not limited to Nyx, Outview and its versions, including Outview Go, and related tools provided by darkrain, you agree to these Terms of Service. In these Terms, “Outview” means Outview and its versions, including Outview Go.
If you do not agree to these terms, you must not use the services.
Service Operator
darkrain is operated by an individual based in Hungary.
For privacy, legal, or service-related requests, contact: hello@darkrain.tools
Nature of the Services
darkrain’s services are experimental software projects provided for testing, experimentation, and development purposes.
The services may include Discord bots, desktop applications, web tools, AI systems, local software, and optional third-party integrations.
The services are provided on an “as is” and “as available” basis.
Unless expressly stated otherwise, darkrain’s services do not provide any commercial guarantee, professional guarantee, uptime guarantee, or service-level commitment.
They are not intended to provide professional, medical, legal, financial, emergency, or safety-critical advice.
Experimental Status
- darkrain’s services are experimental projects.
- Features may change, break, reset, or be removed at any time without notice.
- Data, memory, settings, integrations, and access may be modified or wiped as part of testing and development.
- Some features may be unavailable, limited, or discontinued without notice.
There is no guarantee of uptime, reliability, accuracy, security, availability, or continuity of service.
Outview Local Data
Outview and its versions, including Outview Go, are designed as desktop applications where app data is stored locally on the user’s device unless the user chooses to connect or use a third-party service.
darkrain does not collect, receive, or store Outview app data by default.
Data used inside Outview may remain on the user’s own device, such as local settings, local history, local files, local memory, provider configuration, integration settings, authentication data, cached data, and other local app data.
If a user chooses to use an external AI provider, API provider, Google integration, or other third-party service through Outview, data may be sent to that provider as needed to perform the requested action.
Optional Integrations
- Some darkrain services, such as Outview, may offer optional integrations with third-party services.
- These integrations are not required to use the core service unless a specific feature clearly depends on them.
- If you choose to enable an integration, you may be asked to grant permissions through the relevant third-party provider.
- You may revoke third-party access through that provider’s account settings.
Optional integrations may include access to services such as Gmail, Google Calendar, Google Drive, Google Docs, Google Sheets, or Google Tasks, only if enabled by the user.
Third-Party AI and API Providers
Some darkrain services may allow users to choose or configure third-party AI and API providers.
These may include OpenAI, Anthropic, Google, OpenRouter, local models, self-hosted models, or other compatible providers selected by the user.
When a user configures or uses a third-party provider, that provider may receive and process the data needed to perform the requested action.
This may include prompts, messages, files, documents, email content, calendar information, task information, search results, or other content the user chooses to process through that provider.
Third-party providers are governed by their own terms, privacy policies, retention policies, and security practices.
darkrain is not responsible for third-party provider behavior, availability, security, data handling, pricing, limits, account actions, or output.
User Conduct
- By using darkrain’s services, you agree to follow all posted rules, terms, and guidelines that apply to the service you are using.
- You agree not to exploit, abuse, reverse engineer, overload, disrupt, or intentionally attempt to break the services, except where such activity is expressly permitted by applicable law.
- You agree not to use the services for illegal, harmful, malicious, abusive, deceptive, or unauthorized purposes.
- You agree not to misrepresent darkrain’s services as human, official, authoritative, or acting on behalf of another person or organization.
- Repeated or serious violations may result in suspension or permanent loss of access. Appeals may be handled at the discretion of the service operator.
Memory and Data Usage
- Some darkrain services may store and use certain user-provided information through memory, settings, local history, or other systems in order to support functionality, testing, and service improvement.
- Memory behavior, scope, storage location, and retention may vary depending on the service.
- Memory and stored data may change, reset, or be removed over time as part of development.
- Users may request deletion of stored data, subject to technical limitations.
Outview data is stored locally by default and is not collected by darkrain unless the user chooses to use a feature or provider that sends data outside the local device.
Nyx may store user-provided memories to support personalized functionality.
Nyx memories can be deleted by the user where supported, including through natural language requests, available Discord commands, or requests to the service operator.
Additional details regarding data handling are described in the Privacy Policy.
AI Output and Reliance
- Some darkrain services may use AI systems to generate responses, perform actions, or assist with user requests.
- AI-generated outputs may be inaccurate, incomplete, outdated, unexpected, or inappropriate.
- You are responsible for how you use any output from the services.
- You agree not to rely on darkrain’s services for decisions involving health, safety, legal matters, finances, or other high-risk areas.
No Relationship or Representation
- darkrain’s services are not your friend, employee, contractor, legal representative, financial advisor, medical provider, or official assistant.
- No personal, professional, legal, fiduciary, or employment relationship is formed by using the services.
- darkrain’s services do not act on your behalf unless you explicitly use a feature that performs an action you requested.
Limitation of Liability
To the maximum extent permitted by law, darkrain and its operator are not liable for any damages, losses, or consequences resulting from use of, misuse of, or inability to use darkrain’s services.
This includes, but is not limited to, errors, inaccuracies, unexpected behavior, data loss, local data loss, memory changes, integration issues, provider issues, service interruptions, account issues, moderation actions, downtime, discontinued features, or shutdowns.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, or affects any rights users may have under mandatory consumer protection laws.
Use of the services is entirely at your own risk.
Termination of Access
Access to darkrain’s services may be suspended, limited, or terminated at any time, with or without notice, for any reason, including guideline violations, misuse, security concerns, project changes, or service shutdown.
Governing Law and Disputes
These Terms are governed by the laws of Hungary, except where mandatory consumer protection laws, data protection laws, or other applicable laws require otherwise.
If a dispute arises, users agree to first contact darkrain and attempt to resolve the issue informally.
If the dispute cannot be resolved informally, it may be handled by the competent courts of Hungary, unless applicable law gives the user the right to bring a claim elsewhere.
Nothing in these Terms limits any mandatory rights users may have under applicable consumer protection, data protection, or local law.
Changes to These Terms
These Terms of Service may be updated at any time.
Continued use of darkrain’s services after changes are posted constitutes acceptance of the updated terms.
Users will be notified of major changes when reasonably possible.
